OUR SERVICES

Elevitality is a 6-month program designed to be an opportunity for clients to work alongside other passionate people who are all there to support each other and take action to lives of their dreams.  Elevitality is intended to enlighten clients to a new way of thinking and approaching life that will help bring them the health, wealth and happiness they are willing to choose for themselves.

 In support of that purpose, we provide you access to the following services and content as part of Elevitality:

  • a weekly group coaching sessions approximately 50 – 90 minutes in length hosted on Zoom;
  • a daily accountability partner;
  • access to videos, and the course materials.
  • access to replays of the weekly group coaching sessions and other Content the Company makes available to customers as part of Elevitality (“Content”);**
  • access to an exclusive Facebook group with other clients in the Elevitality program;
  • access to an exclusive WhatsApp group with other clients in the Elevitality program; and
  • one 1:1 individual 15 min mental adjustment session with Elevitality team as needed.

** You will lose access to replays after your seat in the Elevitality program ends.

In providing Elevitality, the Company will not provide any medical, legal, financial, or other advice that can only be provided by a licensed professional. The Company will not provide any one-on-one services as part of Elevitality, other than the 15 minute mental attitude adjustment session with Elevitality team. The Company will not act as your copywriter; you are responsible for writing you own copy and conducting all other functions of your business.

Group coaching sessions will be recorded and will be available for review in a private Kajabi community.  You shall not to post, share, or broadcast any of these recorded sessions or otherwise violate the license granted under the Terms of Service.  

You will be able to access the monthly coaching session within 30 days of making your first payment.  To maintain access the monthly facilitation calls after that first thirty days, you must be current with your monthly payments.

You will have access of the Content perpetually after you have completed your payments.

NOTHING IN THIS DOCUMENT TITLED "OUR SERVICES" IS A GUARANTEE, PROMISE OR PROJECTION OF A PARTICULAR RESULT.   The CLIENT understands that the information shared IS NOT ADVICE, PSYCHOTHERAPY OR COUNSELING, THAT THE COACH/FACILITATOR HAS NOT REPRESENTED HIMSELF AS A PSYCHOTHERAPIST OR COUNSELOR. THE CLIENT ENTERS INTO THIS GROUP WITH THE UNDERSTANDING THAT THE CLIENT IS RESPONSIBLE FOR CREATING AND DELIVERING THEIR OWN RESULTS. 

Ordered Services; Price and Payment. Each service marked below (such as by an x in the box next to the desired service) is included in this Order and is subject to the price and payment terms stated next to it. If multiple price and payment options are available, the option marked below will apply to this Order. Each service is further described in the Service Descriptions.

Price and Payment Terms
One seat in the 6-month Elevitality program, starting on the Effective Date and ending 6 months thereafter. Your purchase of the Program includes 1 limited, revocable License to use the Program Materials.

$10,555 total, to be paid as follows: $5,000 on the Effective Date, and $1,111 paid monthly thereafter for 5 months. 

The fee to license Program Materials is $9,500 per license ("Licensing Fee"), if paid in full as one payment, otherwise, $10,555 total, to be paid as follows: $5,000 on the Effective Date, and $1,111 paid monthly thereafter for 5 months. The Licensing Fee for one License is included in the price of the Program. If the Agreement ends early, the Client is required to pay the Licensing Fee in accordance with the Terms of Service, as in effect at any given time, available at https://www.awesomenesslifestyle.com/service-terms.

 

Discounts and Special Promotions. If the Client chooses to pay for an Ordered Service over the course of multiple payments but thereafter pays for the Ordered Service in full within 30 days of the Effective Date, the Client will receive the same discount for paying in full as the Client would have received if the Client initially chose to pay in full on the Effective Date.

Late Fees. The Client shall pay the Company a $50 late fee for each payment the Client fails to pay the Company in full within 14 days of the applicable pay-by date.

Payment Authorization. If an Ordered Service is eligible for payment by credit or debit card, PayPal, or other form of electronic payment ("Electronic Payment"), and the Client chooses to pay for that Service by Electronic Payment, the Client hereby authorizes the Company to charge the credit or debit card or other form of Electronic Payment that the Client provides to the Company or the Company's payment processor. The Company and the Company's payment processor may keep the card or other Electronic Payment information on file and automatically charge the Client (in accordance with the schedule stated above, if applicable) without prior notification unless the date or amount changes, in which case the Client will receive notice 10 days in advance of the change. The Client shall provide a back-up form of payment if the first form of Electronic Payment does not process or declines. The Client's refusal to authorize any form of payment or the Client’s dispute of an Electronic Payment properly processed under this Order will be a material breach of contract.

Entire Agreement. The following documents comprise part of this Order:

Our Services ("Service Descriptions"); one or more documents issued by the Company stating discounts or special promotions if such documents are attached to this Order at the time the Order is signed by the parties; The Company’s Terms of Service, as in effect at any given time, available at https://www.awesomenesslifestyle.com/service-terms ("Terms of Service"); and Our Community Standards, as in effect at any given time, available at https://www.awesomenesslifestyle.com/community-standards ("Community Guidelines"). This Order, including the documents listed above, constitutes the entire understanding between the parties regarding the subject matter of the Order.

Definitions. Capitalized terms not defined in this order form have the meanings given to them in the Terms of Service.

Client's Representations. The Client states that the following are accurate: that the Client signs this Order in Client's capacity as a business or business owner, and Client does not intend to use the Company's services for personal, family or household purposes; that if the Client is a legal entity (such as a corporation or limited liability company), the Client is an active business in good standing with the state of its formation, and the person submitting this order is authorized to do so on the Client’s behalf; that the Client understands this Order authorizes the Company to charge the Client's credit or debit card or other form of Electronic Payment and to otherwise process payment in accordance with this Order; that the Client understands and acknowledges that the Company is not acting in the capacity of a medical doctor, physician, psychologist, clinical social worker, licensed marriage and family therapist or other licensed professional; that the Ordered Services are not a replacement for services by such licensed professionals; and that the Client is encouraged to seek their professional services; that the Client understands and acknowledges that the Client's results from the Services will depend on the Client's participation, the Client's efforts, your state of mind, and other circumstances outside of the Company's control, and that the Client is responsible for the Client's own outcomes and success; that the Client understands and acknowledges that, although Events might be scheduled on a weekly or monthly basis, this agreement is binding and in effect for the full term of any Program ordered in section C, regardless of whether the Client pays up front in full or over time through multiple payments; that the Client understands and acknowledges that the Client owes the full price for the Ordered Services, regardless of the extent the Client participates in or utilizes the Ordered Services, and that the Client is not entitled to end Our Relationship (as defined in the Terms of Service) early or to receive any refund; that the Client understands and acknowledges that the Client owes the full price for the Services and is not entitled to any refund even if: the Client does not participate in or utilize the Program; the Client fails to achieve a particular outcome or desired result;

Our Relationship ends early after the Client breaches it; the Client is removed (temporarily or permanently) from the Company’s events or forums or otherwise prevented from participating in an Ordered Service due to violating the Community Standards or the Terms of Service; or the Client otherwise does not complete the membership, subscription, or other aspect of an Ordered Service;  that as of the Effective Date the Client has sufficient financial means to pay the full price for the Ordered Services, that the Client will not experience financial hardship by fulfilling the Client's payment obligations under this agreement, and that the Client is not depending on the Ordered Services helping the Client achieve a certain outcome to be able to pay for the Services; that the Client understands and acknowledges that the Company is granting the Client a limited License to use the Program Materials; the Company may revoke the License in accordance with the Terms of Service; and that the Company may require the Client to pay a Licensing Fee if the Client uses the Program Materials inconsistently with the License's scope or after the License is revoked; THAT THE CLIENT UNDERSTANDS AND ACKNOWLEDGES THAT THE COMPANY’S TERMS OF SERVICE ARE INCLUDED AS PART OF THIS ORDER AND CONTAIN MULTIPLE TERMS AFFECTING THE CLIENT’S RIGHTS, INCLUDING A BINDING AGREEMENT TO ARBITRATE DISPUTES, A WAIVER OF JURY TRIALS, AND LIMITATIONS ON CERTAIN DAMAGES; that the Client has carefully reviewed this Order (including the Service Description, Terms of Service, and Community Standards), understands its terms, and acknowledges the Client has had an opportunity to ask the Company questions and consult with an attorney; and that the Company may rely on these statements by the Client.

By completing this Order, the Client hereby offers to purchase from Awesomeness Lifestyle, Inc the Ordered Services under the terms of this Order. If the Company accepts this Order, the Order (including the Terms of Service and attachments) will become a binding agreement between the Client and the Company.
